The original is implemented on PIC18F4455 of 16 MHz crystal. I don’t have any version of Diolan's bootloader, I’ve downloaded it from the original site, I'm working with one of the many versions of the Diolan's ASM bootloader I am not looking for a coded solution, but some understanding on the problem, so any light on the subject is welcomed. I thought it had to do with PKTDIS bit, but what I tried did not seem to work.

2) How do I tell the SIE not to transfer data (until the data is there, that is). but I can't seem to get it from the documentation. Of course I am not understanding how USB does this. This should be triggered by the PC, otherwise I don't get why the timing difference between the two hosts. but I don't understand two things: 1) What is triggering the SIE transmitting the empty packet to the host. So I understand the SIE is sending the empty packet. This is almost always on the fast PC and never on the slow PC. Here is where the timing problem comes to light: all malformed packets occur when the time between the request and the response is less than about 100us. These malformed packets actually have no data (they end at 64 bytes) while when answering to the slow PC they contain data (beyond 64 bytes) and are correct. I did some data capturing with Wireshark and I clearly see that the problem is that the PIC is returning malformed "descriptor request" packets to the fast PC. It works without problem when connecting to a slow PC, but does not when connecting to a FAST PC.
